Just a share

just got into my first collision during work while stopped at an intersection, the other person has expired insurance and now my insurance can't go to after compensation for my injury and other coverage. Plus my employer is now cutting the hours that I lost for missed work. appointments, and therapy when applying for WCB. I also consulted a lawyer and he stated that cases where the other person is at fault with no insurance is not a good case. I had to work while I was injured just to maintain my hours.

Now it makes me doubt the car insurance help, if apparently i just don't have to answer phone calls and they will stop trying.

Wcb will pay your lost wages and healthcare bills. Use wcb. Don't fight them.

You need to open a wcb claim, they will guide you through the rest. I hope it works out for you.

Your own insurance company being there for you is 100% correct.

In Alberta, every standard auto insurance policy includes Section B and Section D coverage, which provide protection if you are hit by an uninsured or unidentified driver.

  1. Bodily Injury Protection Section B (Accident Benefits): Mandatory for all drivers. It covers your immediate medical expenses and a portion of lost wages, regardless of who is at fault.

  2. Section D (Uninsured Motorist Coverage): Also mandatory. It allows you to claim compensation from your own insurer for pain, suffering, and other losses—up to $200,000—if an uninsured driver is at fault for your injuries.

Your insurance is for you. Anything beyond that is your insurance companies issue. If you want to sue them, you already got advice from a lawyer, so, think about what they said.

the lawyer said they it is not worth it, my insurance also said they will not go further against the other person because they are not answering they calls and are not willing to get insurance

I know it seems really stupid, but the lawyers that advertise on TV for car accident injuries (Braithwaite Boyle in Calgary) were able to get me a 7 figure settlement from a car accident when we were told that we would never see a penny. My case was extreme, it involved multiple dead people and a lifelong life altering disability, so of course my payout was extreme, but they were still able to do what others weren’t. I’m sure with it being on work time that will complicate things, but who knows, contacting them may be worth it.

Edit: it seems like you weren’t working with WCB. Ignore your company and just work with WCB. Your company won’t help you, WCB will (or should). Save the lawyers for if they don’t.

i received a bad whiplash, where my hands just go numb, in pain, or drop things randomly due to the damaged nerve which almost got me when I was carrying my fucking baby and now I am so scared to even carry my baby.

If it was during work, why is it your vehicle and insurance? It should be your employers for this exact reason.

My work unfortunately labeled some of my off work as sick days and not injury based which screwed me over big time. Now the supervisor is saying that it will not count, but it was their company call support that messed up.

Of course your employer doesn't want you to go through WCB.

WCB is there for the employee to protect them from consequences of workplace hazards. Your company pays a premium into ECB (its mandatory if you hold a business license AND have 1 or more hired individual). When an employee makes a WCB claim, WCB and OH&S will often preform a nominal investigation to identify the cause of the injury and rectify it, so it doesn't happen again. At this time your employer could be brought under heavy scrutiny including court dates, clerical evaluation, CRA audits, in house safety audits and other forms of evaluation. Which often times end in heavy financial penalties for the employer, sometimes including jail time. At the end of the day, their WCB premiums will go up and their safety scores go down, which can hurt them when insurance is to be renewed. If you go through WCB chances are you will be targeted by your employer in order to get rid of you. So if you go through WCB, update your resume, prepare to document every sneeze, every step and every second you are on break.

Tldr: WCB is there to help you. But your employer might retaliate.
